The Madras High Court quashed the order demanding payment on all trade payables, ruling that the order exceeded the scope of the original show cause notice. This was an audit case, and the audit team has raised numerous demands on this issue. This ruling will benefit many.
Facts & Timeline 📅: The petitioner challenges an order dated 31.12.2023, arguing it exceeded the scope of a prior show cause notice by subjecting all trade payables to GST.
Following an audit report on 26.09.2023, the petitioner was served a notice on 30.09.2023 for a proposed tax of Rs. 43,66,708.14. However, the final order imposed a tax exceeding Rs. 90 crores, significantly above the initial figure.
The petitioner had complied with statutory requirements for Input Tax Credit (ITC) but was still penalized. The issue revolves around the imposition of GST on the petitioner's entire trade payables, viewed by the petitioner as beyond the notice's scope and the law.
Petitioner's Argument 🗣️: The petitioner contends the order improperly expanded the taxable amount far beyond the initial estimate, unjustly taxing trade payables as a taxable supply despite adherence to ITC regulations.
Court Judgment ⚖️: The High Court of Madras found the imposition of GST on trade payables, as presented in financial statements, prima facie untenable.
The court quashed the order, requiring the petitioner to remit 10% of the disputed amount, excluding trade payables, and directed a fresh review with a reasonable opportunity for the petitioner to present their case.
