When judges play politics, Davis says, they’re not just overstepping—they’re undermining the Constitution. “You have these uni-party federal judges, these activist judges who are unlawfully, unconstitutionally, dangerously trying to curtail the President’s Article Two powers. For example, we have a judge telling the President and his Treasury Secretary that they can’t look at spending data at the Department of the Treasury. That is certainly not constitutional for a judge to rule that the President has the executive power.” Another ruling by Judge Carl Nichols delays the recall of USAID employees, despite Trump's clear executive authority.
